Helpful tips when dealing with
collectors:
When dealing with collectors they will
often pressure you to pay the debt immediately. They may even
tell you that you have to pay your debt by a certain day or
else they will take some sort of action. This is a scare tactic
to get you to pay the debt as fast as you can. The truth to the
matter is you don’t have to. You are entitled to a monthly
repayment just as if it was a loan through the bank.
Collectors will often call you at work to try and settle the
debt. This is actually illegal. By law collectors are allowed
to contact your place of employment once to verify employment
and anything above and beyond that is not permitted under the
debt collection act. If you have a collector calling your place
of employment simply state that they are not to be calling you
at work and provide them with an alternative number.
Collectors are bound to the rules and
regulations of the debt collection act. Any condescending or
derogatory behaviour is not permitted by the act. If a
collector is being belligerent, rude, or unreasonable simply
ask him/her for their license number. The license number of
their organization and file a complaint with the governing
body. By law a collector must give you their license number if
asked for. Often times they will tell you they are not required
to but this is simply untrue.
Collectors cannot refuse payment on a
debt. If you have a collection agent that is unwilling to make
a financial arrangement with you simply get the address of the
company and start sending payments. Collectors must post the
payments to your accounts and are limited to the means they
have to collect. As long as you are making monthly payments you
have the upper hand.
